Employee Referral Award Program

The Employee Referral Award Program (“ERAP” or “Program”) provides discretionary cash awards to support organizational needs in the recruitment of top talent for difficult to fill and other designated positions within the CCPORTER Sp. z o.o. by referring applicants who are selected and successfully employed. The ERAP is not a game of chance, raffle lottery, mutual bet, a game whose outcome is random, or any other form provided for in the Act of 19 November 2009 “o grach hazardowych” (Dz. U. Nr 201 poz. 1540, ze zm.).

Who can be referred?

Candidates are eligible for employee referral provided they:

1. Are External Candidates that are not currently employed by CCPORTER or CCPORTER’s Clients in any form, including temporary, casual, hourly, or student workers; and

2. have not previously worked at CCPORTER or CCPORTER’s Clients (Candidate must have not been employed by CCPORTER or CCPORTER’s Clients in previous 12 months through payroll, accounts payable or temporary agency).

How do I refer someone?
To refer a Candidate you should find the open position at Employee Referrall Module, then fill the form with your contact details and generate an individual link to application form, which might be shared with the potential Candidates. Then the Candidate is required to apply via provided link and send cv to CCPORTER itself.

Is there a cap to how many employees’ I can refer?
No, there is not a referral cap but each referral should relates to a different Candidate.


What is the referral reward?
The Organizer will determine the referral Bonus according to Employee Referrall Module.

The Program Participant will be eligible for Award if:

1. External Employee’s stays within the organization for minimum 90 days of
consecutive employment after onboarding training and

2. The Program Participant is CCPORTER’s or CCPORTER’s Clients current employee or who are involved in CCPORTER’s partners projects and he or she is not during the notice period.

The External Employee will be eligible for Award if he or she stays within the organization for minimum 90 days of consecutive employment after onboarding training.

How will I know that a referral has been hired?
You will receive notification. The HR Department will contact you and send you via email a form which is necessary for the Organizer to prepare relevant payment documents. If you fails to provide this data, the Organizer will not be able to pay you the Award.

Referees Personal Data processing
Personal data controller is employment agency CCPORTER sp. z o.o. with its registered office in Warsaw (01-171), at ul. Młynarska 42/115. In case of questions and requests regarding personal data, please contact: rodo@ccporter.com or the correspondence address of the Company. Providing data is necessary to participate in the Program.

Purposes and legal basis for the processing of personal data: participation in the Program – art. 6(1)(b) GDPR (processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract). Additional information will be required when a bonus is awarded – art. 6(1)(c) GDPR – processing is necessary for compliance with a legal obligation (tax, accounting) to which the controller is subject.

The recipients of personal data may be entities providing elements of IT infrastructure (in particular software).

The controller will not transfer data to third countries. Personal data will be processed for the period of participation in the Program. In the case of awarding a bonus – for periods resulting from tax and accounting regulations.

You have the right to: request access to personal data; request their rectification; request their erasure; request to transmit data to another controller; requests restriction of processing. You have the right to lodge a complaint with the supervisory authority regarding the processing of personal data by the controller In Poland – the President of the Personal Data Protection Office.

Your personal data is not subject to automated decision making, including profiling.

Candidates Personal Data Processing

Providing data is necessary to participate in the recruitment Program.

Purposes and legal basis for the processing of personal data: participation in the recruitment Program according to its rules – art. 6(1)(b) GDPR (processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract). With the separate consent the candidacy is presented to a specific potential employer and also participate in future recruitment processes [art. 6(1)(a) GDPR]. Additional information will be required when a bonus is awarded – art. 6(1)(c) GDPR – processing is necessary for compliance with a legal obligation (tax, accounting) to which the controller is subject.

The recipients of personal data may be entities providing elements of IT infrastructure (in particular software), recruitment portals and potential employers.

The controller may transfer data to third countries, in which case, he will obtain a separate consent and inform about the accompanying risks or conclude a contract based on standard clauses adopted by the European Commission.

Personal data will be processed for the period of participation in the Program (12 months from submitting the application, and additionally 3 months from finding employment). In the case of awarding a bonus – for periods resulting from tax and accounting regulations. In the event of consent – the data will be processed for 2 years for the purposes of future recruitment.

You have the right to: request access to personal data; request their rectification; request their erasure; request to transmit data to another controller; requests restriction of processing. You have the right to withdraw given consent at any time – which not affect the lawfulness of processing based on consent before its withdrawal. You have the right to lodge a complaint with the supervisory authority regarding the processing of personal data by the controller. In Poland – the President of the Personal Data Protection Office.

Your personal data is not subject to automated decision making, including profiling.

Complaints

Definitions

1. The Organizer/We – CCPORTER Sp. z o.o
2. Program/ERAP – The Employee Referral Award Program
3. Program Participant – CCPORTER or CCPORTER’s Clients current employee who will send referral to the Organizer, excluding legal entities and entrepreneurs conducting business activities which provide professional recruitment services, as well as employees and associates of the Organizer and companies related by capital or personally to the Organizer, in particular being a related company.
4. Referral Employee/Candidate/External Candidate – a natural person meeting the formal requirements indicated in the job advertisement, who is a personal contact of Program Participant.
5. Award/Bonus – cash award both for Program Participant and Candidate. The award will not be paid if any provisions of ERAP were violated by Program Participant or Candidate. For Referral Employees – awards are considered supplemental wages and
are reduces by taxes, fees and other legal obligations. For Program Participants – taxes, fees and other legal obligations are paid directly by them.

Final provision

We may change ERAP over time. We also reserve the right to abolish certain rewards if they prove ineffective or inefficient. Program Participant who referred Candidates before an award was abolished or changed will still receive the appropriate Awards.

Personal data will be used by us for the period necessary to respond and then stored for a period of several months. Marketing purposes will be carried out until you withdraw your consent. Provision of personal data is voluntary, but failure to do so is linked to the inability to receive an answer to the question asked. Receiving marketing content is voluntary. Data will be transferred only to entities providing support services to us, including legal and IT services, with such entities processing data on the basis of contracts concluded with us and only in accordance with the Administrator’s instructions. In addition to the above-mentioned entities, your data may be made available only at the request of entities authorized to do so by law.
